Texas taking new approach to holding the line on refugee resettlement…

…..Feds expect Texas to take 25% more refugees in FY2017—a whopping 11,020—and Texas is saying NO!

Texas is the number one state in the nation for refugee resettlement (the goal is to turn red states blue!) and frankly I believe it got that way because previous governors weren’t paying attention, but that is water under the bridge so they say.

The Texas Commissioner is corresponding with BARBARA DAY, the Domestic Resettlement Section Chief at the DOS Bureau of Population Refugees and Migration. She is the person in charge of resettling refugees into your towns and cities. Day is also an example of the revolving door between federal contractors and the agencies from which they get their federal funds. Day came originally from Lutheran Social Services of SD and then to a perch at headquarters—Lutheran Immigration and Refugee Service (LIRS) —before getting her present position at the US State Department in 2005. There really should be a law against this contractor/federal agency revolving door! You probably saw the news that Governor Abbott’s recent lawsuit was dismissed. But, what the Abbott administration is doing now bears watching.
We’ve told you before (here) that states must submit a plan to the federal government each year about how the program will be run in the state. They can get away with not renewing the plan if nothing has changed.
Most plans are just rough bureaucratic blue prints (that they probably don’t follow anyway). But, back in April of last year, I wanted you to get yours mostly to send a signal that you were watching.

Now we see that Texas is taking this plan seriously and is attempting to use it to keep the US State Department from increasing the numbers to be sent there.

(BTW, a reminder! When hundreds or thousands (like in TX) of refugees have been resettled and the State Dept. is working to bring in their extended family members you can see how the numbers will mushroom exponentially.  The DOS wants to get the relatives into the same towns (or at least nearby) where their family members have been placed (seeded!). This is why I say in ‘Ten things your town needs to know’ that once they open an office and bring in the first refugees, your town is cooked!)

AUSTIN – The federal government wants Texas to accept more than 2,000 additional refugees this year. Texas’ response: No thank you.

The Texas Health and Human Services Commission is putting the federal government on notice that the state will refuse to take in more refugees than it did last year and will accept only those who do not pose a security risk.

Texas on Friday submitted to the U.S. Department of State a 2017 state plan for refugee resettlement, rejecting the federal government’s proposal to increase the number of refugees moving to the Lone Star State by 25 percent.

“Texas continues to have concerns about the safety of its citizens and the integrity of the overseas security and background vetting process of the federal resettlement program,” Executive Commissioner Charles Smith wrote in a letter to the U.S. Department of State. “Americans face an undeniable terrorist threat that is imported through new manipulations of our national security protocols each day.”

According to Smith’s letter, the federal government is proposing to place 11,020 refugees in Texas during fiscal 2017, an increase of 25 percent over the projected fiscal 2016 figure. Smith wrote that the proposed funding is insufficient, as well, and concludes the state could accept a maximum of 8,605 refugees. It is unclear how many refugees have been placed this fiscal year, which ends Sept. 30.  [One could easily find out how many refugees have been resettled in Texas this year until just a few days ago.  It appears that the Dept. of State has removed its data base that reporters have been using for months from public view.—ed]

Rewriting their plan to add security requirements for the feds!

Smith sent his letter and the state’s 2017 plan for handling refugee settlements in response to an email from Barbara Day, chief of domestic resettlement for refugee admissions at the Bureau of Population, Refugees and Migration in the state department. According to Smith, the letter to Day outlined the agency’s plan to boost the number of refugees settling here, although the Texas commission could not produce the letter late Friday.

Texas will accept only refugees who can be certified to Congress that they do not present a security threat, according to Texas’ 31-page version of a resettlement plan that would take effect in the new fiscal year that begins Oct. 1. According to the proposal, the FBI must certify to the Department of Homeland Security and the Director of National Intelligence that potential refugees have received a background check sufficient enough to determine whether the individual is a security threat, and may only be admitted to the U.S. after all three agencies certify to Congress the individual is not a threat.

Contemplating 'welcoming' refugees? Pay attention to Amarillo, TX

Amarillo was in the news this week when a former refugee was shot dead in a Walmart store after taking hostages.  If you are looking for excitement in your boring towns and cities, follow the Amarillo example. If you kind of like your peaceful all American town, then you better think twice about becoming a new refugee resettlement site. (And, make all the political noise you can when the feds come to town with their contractors).

Amarillo has been getting refugees for years and years so that is why they are now overloaded and stressed.  I suspect early on, the federal contractors snuck into town (they always set up the seed communities with the least amount of publicity they can get away with) and no one caught on until the schools were overloaded and multiculturalism had destabilized the resident population.

A man who took two co-workers hostage at an Amarillo, Texas, Walmart Tuesday was a Muslim refugee from Somalia, and that fact came as no surprise to those who track the federal government’s robust refugee resettlement program.

Amarillo is bursting at the seams with foreign refugees, from Africa, Asia and the Middle East, and its mayor has pleaded repeatedly with the government to stop sending refugees to his city.

But they keep coming.

The schools are stretched, and the local police department is having a hard time getting a handle on the rising crime.

On Tuesday, it was just another example. Mohammad Moghaddan, a Somali refugee, was shot and killed by sheriff’s deputies after he had taken two Walmart employees hostage.

Moghaddan, 54, was a current employee of the store, and his actions were quickly declared “a case of work place violence” by the sheriff’s office. The hostage taker, armed with a handgun, was shot dead by a SWAT team as terrified shoppers were ushered out of the store.

The city’s mayor has been on a crusade since 2011 to get the U.S. State Department, working with the United Nations, to put a damper on the number of refugees flooding into his city.

So far, Mayor Paul Harpole has had little success.

And, again for you in prospective ‘welcoming’ towns remember the message from Amarillo—once you go down this road and open an office in your town there is no slowing the flow later.  Just ask another mayor, Ted Gatsas in Manchester, NH who like Mayor Harpole has tried to persuade Washington to stop sending so many, to no avail.
See our Amarillo archive which extends back to 2008.  This May 2008 post may be our earliest realization that Amarillo was being changed by BIG MEAT in need of cheap immigrant labor or, because the federal government makes it attractive (financially beneficial) for them to hire non-Hispanic laborers (hmmmm?), see here. BTW, in a quick look around I saw that there are 11 meatpacking companies near Amarillo. Why is it the job of the US State Dept. to provide laborers for processing plants, that is what I want to know!

I was out this afternoon and heard news on the radio that a man had taken hostages in an Amarillo, TX Walmart and knew right away another Muslim was involved.  The radio news I heard never mentioned the man’s identity so as soon as I came in, sure enough here is ‘100 percent fed up, on twitter ***with the news.  He is Somali, one of probably a thousand the US State Department has planted there so BIG MEAT would have a ready supply of cheap labor.

Lt. Erick Bohannon with Special Crimes identified the suspect as 45-year-old Mohammad Moghaddan, a former employee of Walmart. Bohannon cited an apparent dispute between Moghaddan and a former manager as a possible motive for Tuesday’s events. [LOL! Workplace violence, move along, nothing to see.—Ed]

Officials believe Moghaddan barricaded himself, the unidentified manager, and another person inside an office.

The city’s police department, state troopers, and the Randall County Sheriff’s Office among other agencies all reported to the location around 11 a.m. when the first calls were received. Just over an hour later, tactical units entered the building, located the suspect, and fatally shot Moghaddan. via: KSLA

Big news! Kansas watching Tennessee on refugee lawsuit, but bigger still, so is Texas!

Big news! That’s for sure!  Texas? Maybe Maine and Florida?

Gov. Sam Brownback’s recent decision to withdraw the state of Kansas from the federal refugee resettlement program may be just the first step in a full-fledged battle with the Obama administration over state sovereignty issues.

If more governors opt out, thus throwing the program into bureaucratic chaos, Obama might not get his Syrian Muslim quota. Boo hoo!

“We are aware of the legal argument and watching for developments,” Gov. Brownback’s spokesperson Eileen Hawley tells Breitbart News about the lawsuit the Tennessee General Assembly has declared it will file on Tenth Amendment grounds against the federal refugee resettlement program.

Hawley’s comment is just the latest indication of growing state resistance to the Obama administration’s efforts to increase the resettlement of Syrian refugees, even in states that have made clear they do not want them.

Several states currently participating in the program may be considering withdrawing as well.

“Our contract is up in one month and we are currently evaluating our options,” a spokesperson for Gov. Greg Abbott of Texas tells Breitbart News.

The spokesperson was referring to the contracts*** between the State of Texas and local resettlement agencies, or VOLAGs, for the operation of the federal refugee resettlement program in the state.

“The Governor in conjunction with the refugee coordinator ” were identified by the spokesperson as the responsible parties evaluating current options. [One option is to opt-out!—ed]

Sources tell Breitbart News that Maine and Florida are two additional states that may be considering withdrawal from the federal refugee resettlement program.

Remember readers, the feds argue that if states opt-out as provided for in the original 1980 Act, the feds can simply assign a non-profit group to run the program in the state.  The Thomas More Law Center claims that such action is not constitutional according to the Tenth Amendment.  Additionally, it appears to critics that the Wilson-Fish* amendments do not contain the authority for the federal government to pass on to an unelected, non-governmental entity the right to make decisions which expend state and local tax dollars.
This is a two step process and in order to possibly succeed, the state must withdraw, become a so-called Wilson-Fish state, and then file a lawsuit described in the Breitbart story, continue reading here.
Maybe if the whole system is thrown into legal chaos, Obama won’t get all of his Syrians in by September 30th.

Texas should withdraw from UN/US State Dept. Refugee Admissions Program

Just as Governor Sam Brownback did in Kansas this week, Texas should “opt-out” of the UN/US State Department Refugee Admissions Program and then when the feds put a ‘non-profit’ group in charge of making decisions that expend taxpayer dollars in the state—sue the feds on Tenth Amendment grounds.  It is that simple (well sort of!).

If Texas has no say over refugee seeding now, then the state should simply withdraw from the program and then sue the feds.

Any governor in America who talks big about wanting to get the RAP under control in their state, isn’t doing anything (other than trying to appease voters) until he or she takes dramatic action—like withdrawing from the program altogether.
(For readers who don’t want to kill the program outright, dramatic action is the only thing that will bring enough controversy to even begin to see the smallest effort toward reform.)
This Breitbart headline (Texas Has No Authority Over Agencies That Resettle Refugees in State) and story caught my eye.
Texas is the top resettlement state in the nation and has a governor who has been attempting to protect the state, so why not go for the whole enchilada. (Congress should be protecting you, but it isn’t!)

Since 2011, Texas has ‘welcomed’ approximately 7,000 refugees a year so that it continues its distinction as the #1 refugee state in the nation. Looks to me like Gov. Rick Perry closed a blind eye to the expansion.

For new readers, know that these states (below) already withdrew (or never had a program) at one point in the past and are now so-called Wilson-Fish states whose refugee programs are run illegally and unconstitutionally by ‘non-profit’ groups hired by Washington.

By the way, experts tell me that the Wilson-Fish amendment to the Refugee Act of 1980 made no provision in the law for the federal agencies to pass the program off to unelected non-profit contractors of the federal government—one of many many cases where a federal agency (the Office of Refugee Resettlement in this case) simply made its own ‘law’ through regulations.
If you are in one of these states you must urge your governor/legislature to sue with a states’ rights claim.
I know you won’t get states like Vermont to demand their state’s rights, but heck then if they are that ‘welcoming,’ let the feds just send them all there.
(I saw news last night and tweeted it that the Rutland, VT mayor is welcoming 100 Syrians soon. Follow me on twitter for more news.)
